US Court Mandates Freedom of Abrego Garcia from ICE Detention

A court has ruled the immediate discharge of Kilmar Abrego Garcia from immigration custody, concluding his continued confinement lacks legal authority.

"Since Abrego Garcia's return from wrongful detention in El Salvador, he has been taken back into custody, again without lawful authority," Judge Paula Xinis wrote in her order.

The situation stems from a mistaken removal to El Salvador in March, which US authorities later admitted was an mistake. After his repatriation to the United States to face alien smuggling allegations, he was detained in immigration detention.

In her order, the judge noted that the government lacks a valid removal order, which effectively blocks them from removing Mr. Abrego Garcia "for now."

Context of the Case

The court proceedings involve disputed claims. Whereas the former administration argues that Abrego Garcia is a affiliate of the MS-13 criminal organization, he vehemently disputes this allegation.

He has also pleaded not guilty to the conspiracy counts, which are part of a separate criminal case in the state of Tennessee.
